'It was a case of mistaken identity' Bengals LB Foley cleared of gun incident in LouisianaPosted: Saturday April 08, 2000 04:09 PM
MONROE, La. (AP) -- Cincinnati Bengals linebacker Steve Foley has been cleared of an accusation that he fired a handgun outside a nightclub last week, the city's chief prosecutor said Saturday. Foley, who played college football at Louisiana-Monroe, was booked Thursday with a misdemeanor disturbing the peace charge after a man walked through a bar parking lot and fired 10 to 15 shots in the air. Monroe chief city prosecutor James Pierre said Foley was initially identified as a suspect by several witnesses. But the witnesses never saw Foley with a gun, Pierre said. They heard a bouncer yelling Foley's name and assumed he had the gun, but the bouncer was warning Foley to take cover, Pierre said. "It was a case of mistaken identity," Pierre said. Foley, who lives in Little Rock, Ark., was cleared after several more witnesses came forward Thursday and Friday and gave statements. Pierre said he gave a letter to Foley's lawyer Friday absolving his client of guilt. Foley's arrest was his fourth in a year. In February, Foley was booked with domestic violence after he reportedly kicked in the door of the apartment of his son's mother and grabbed her by the throat. He has denied the allegation, saying he simply came to the apartment to pick up his child to go out for a meal. In April 1999, Foley was arrested on a warrant accusing him of failing to appear in court on a nonsupport charge. After he was freed on $2,000 bond, he was arrested the next day and booked by Louisiana State Police for driving while intoxicated. Foley played for Louisiana-Monroe when it was known as Northeast Louisiana. He told The Cincinnati Enquirer Friday that he had feared the arrest in Monroe would prompt his suspension for the first four games of the season. "I'm relieved some of these guys came forward and backed up my story," Foley said.
