Infant son of Carruth expected to receive child support

CHARLOTTE (AP) -- Rae Carruth's financial obligation to his infant son will be determined by a judge looking at whether the former Carolina Panthers player accused of killing the boy's mother should pay child support.

A hearing scheduled for Monday in Mecklenburg County court in which child support is expected to be set for Chancellor Lee Adams.

Judge Yvonne Mims Evans also may rule on a motion by Carruth's attorneys to allow Carruth to visit with the baby at the jail, where the former player has been held without bond since December in the death of the boy's mother, Cherica Adams.

Cherica Adams was shot Nov. 16 in a drive-by shooting while driving in south Charlotte. Adams, 24, was pregnant with Carruth's baby and gave birth soon after the shooting. The child survived by Cherica Adams died a month later.

Carruth and the three co-defendants are charged with first-degree murder, and prosecutors have said they will seek the death penalty against all four men.

Cherica Adams' parents have sued Carruth for custody of Chancellor and for child support. The mother of Cherica Adams has temporary custody of Chancellor.

Evans in December froze Carruth's assets so attorneys could analyze them and determine how much child support the former football player should pay.

According to court papers filed in the criminal case, Carruth had a net worth of almost $480,000, including about $175,000 in bank accounts, the day Adams was shot.

Carruth's lawyer, Bill Diehl, has said the former football star is not obligated to liquidate his assets to pay child support. Diehl has said that since Carruth's income ended with his arrest, his child support obligation is zero under the law.

Carruth also has a 5-year-old son in California. That child's mother also is seeking child support.
