Romanowski lawyer's filing argues for dismissal

CASTLE ROCK, Colo. (AP) -- Criminal charges against the wife of Denver Broncos linebacker Bill Romanowski should be dropped because they were obtained through questionable investigative techniques, her attorney said in court documents.

Harvey Steinberg wrote in a request to have the case dismissed that agents threatened the Romanowskis' nanny with deportation, used threats and promises to induce Julie Romanowski's doctor to secretly record phone conversations with her and her husband and harassed the couple during an autograph-signing appearance.

Julie Romanowski is charged with one count of conspiracy to obtain a controlled substance by fraud and deceit and eight counts of obtaining a controlled substance by fraud and deceit. Her trial is scheduled for March 13.

She is accused of obtaining prescriptions for a diet drug and then providing it to her husband. The drug, phentermine, is believed by some to enhance athletic performance by increasing the metabolism.

Bill Romanowski is charged with one count of unlawful possession of a controlled substance, two counts of conspiracy and one count of obtaining a controlled substance by fraud and deceit. He is scheduled to be arraigned Tuesday.

Steinberg declined to comment on the request to dismiss charges.

In his filing, Steinberg said during the investigation, five agents entered the Romanowski home without permission, separated Julie Romanowski from her husband and interviewed her without advising her of her rights.

Steinberg has filed a motion to have statements made to agents during that Aug. 21, 1999, visit suppressed.

Steinberg also wrote that the district attorney's office made statements to the media that appeared to be calculated to embarrass his clients. District attorney spokesman Mike Knight said his comments were taken out of context.

  • The Romanowskis are to appear in court Tuesday to be advised by independent attorneys of the possible conflict that could arise from being represented by the same lawyer.
