NASCAR PLUS BENNY’S MAILBAG OFFICIAL RULES AND REGULATIONS THE FOLLOWING IS INTENDED FOR VIEWING IN THE UNITED STATES (EXCLUDING PUERTO RICO) ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT PROCEED WITH THIS PROMOTION IF YOU ARE NOT LOCATED IN THE UNITED STATES OR IF YOU ARE LOCATED IN PUERTO RICO. 1. NO PURCHASE NECESSARY. Contest ("Contest") open to all legal residents of the 50 United States and the District of Columbia except Colorado, 18 years or older at the time of entry, except employees (and their immediate families and household members) of CNN/Sports Illustrated ("CNNSI"), Turner Sports Interactive, Inc., ("Turner"), NASCAR, Inc. ("NASCAR") and its drivers, teams and properties, AOL Time Warner, Inc. and their respective parents, subsidiaries, franchisees, participating vendors, distributors, advertising promotion agencies and affiliated entities (collectively the "Sponsors"). Void in Colorado and wherever taxed, prohibited or restricted by law. Contest is subject to all federal, state and local laws and regulations. By entering the Contest, participants agree to accept and be bound by all terms of these Official Rules and Regulations. 2. HOW TO ENTER: Beginning Monday, July 16, 2001 CNNSI will conduct a weekly contest to determine who has written the best question to Benny Parsons, host of NASCAR Plus on CNNSI (the "Show"). The contest will run from 12:00 a.m. (ET) on the Monday of each week until 11:59 p.m. (ET) on the Sunday of each week (the "Contest Period"). Questions may be submitted by one of two methods. 1) Users can e-mail their questions to Benny Parsons by going to NASCAR.com or CNNSI.com and clicking the "Benny's Mailbag" banner. Users must register before sending in a question. There are no charges for registration. False or deceptive entries or acts will render the entrant ineligible; or 2) Users can mail-in their questions by following this procedure: print name, address, age, phone number and question on a standard postcard and mail it, first class, pre-paid to:
Benny Parsons Mailbag All questions must be received by 11:59 p.m. (ET) on the Sunday immediately preceding that Monday's Show. All entries become the property of the Sponsors and will not be returned. One entry per person, household and e-mail address per week. 3. HOW TO WIN: One (1) winner (the "Winner"), deemed to have submitted the best question during the Contest period, will be chosen by Benny Parsons on or about the airing of NASCAR Plus each Monday night, from all eligible entries received by the dates specified above. The decisions of Benny Parsons will be final and binding. The odds of winning will depend on the total number of eligible entries received. The Winner will be notified by telephone within fourteen (14) days of the decision and must meet all eligibility requirements including the execution and return of all necessary releases. 4. PRIZES: One (1) Winner will receive assorted licensed NASCAR merchandise (the "Prize") that may or may not include the following; NASCAR T-shirts at an approximate market value ("AMV") of Thirty Dollars ($30.00), NASCAR leather jacket at an AMV of Two Hundred and Fifty Dollars ($250.00) and NASCAR die-cast collectible cars at an AMV of Eighty Dollars ($80.00). No substitution or transfer of Prizes or cash redemptions permitted by Winner. Sponsors reserve the right to substitute any Prizes in the event the described Prizes, or any portions thereof, are unavailable for any reason whatsoever. Winner is responsible for reporting and payment of all taxes (if any). 5. GENERAL RULES AND REGULATIONS: By entering this Contest, participants grant Sponsors the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without compensation, for the purpose of advertising and publicizing the services of the Sponsors and all matters related to the Contest in any medium, throughout the world in perpetuity. Winner may be required to sign affidavits of eligibility, liability releases and, except where prohibited by law, use of name and likeness releases and return within five (5) days of issuance of notification. Failure to do so or: (i) if any Prize or Prize notification is returned as undeliverable, or (ii) the Winner declines his or her will result in disqualification of the Winner and an alternate Winner may be selected at the Sponsors' sole discretion. Sponsors will use reasonable efforts to pick an alternate Winner but in the event an alternate Winner cannot be determined, the Prize will go unawarded. Sponsors expressly disclaim any responsibility and participants agree to hold Sponsors harmless for liability for injury or loss to any person or property relating to participation in this Contest or the delivery and/or subsequent use or misuse of any of the Prizes awarded. Sponsors are not responsible for (i) any condition caused by events beyond the control of Sponsors that may cause Contest to be disrupted or corrupted; (ii) any injuries, losses, or damages of any kind caused by a Prize or resulting from acceptance, possession, use, or misuse of a Prize, or from participation in Contest; or (iii) any printing or typographical errors in any materials associated with the Contest. Any entry that fails to provide all required information will be disqualified. Sponsors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; or (iii) errors in transmission. All entries must be submitted in the name of an individual person and the Prize can only be awarded to the person whose name is on the winning entry. No mechanical reproductions or facsimiles accepted. Participants may not enter using multiple e-mail addresses or as multiple participants. Any participant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Sponsors reserve the right, in their sole discretion, to cancel or suspend the Contest should virus, bugs, unauthorized human intervention, or other causes beyond the control of Sponsors, in their sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the Contest. In the event of cancellation, Sponsors may elect to award all Prizes to Winners randomly drawn from among all participants who had entered the Contest at the time of such cancellation. 6.
